The legal age to buy a vape in the United States is 21. Congress raised the federal minimum age from 18 to 21 for all tobacco products in December 2019, in a law known as Tobacco 21, or T21 for short. Here's the part that trips people up. Tobacco 21 sets a national floor, not a ceiling. No state can allow sales below 21, but states and cities absolutely can add rules on top of flavor restrictions, retail licensing requirements, and limits on online delivery are all common. So the age answer is 21 everywhere, and your state may layer additional rules on what you can buy and how it ships to you.

Those articles are pointing to old state statutes that were written before 2019 and never cleaned up afterward. Before December 2019, you could in many places, which is exactly why so much outdated advice is still floating around online and in conversation. Any article, forum post, or word-of-mouth tip saying 18 is out of date by more than six years at this point.

The federal age applies to purchasing, and most states tie possession and use to the same threshold. We know that isn't the answer some people are hoping for. But selling to anyone underage puts the buyer and the shop at real risk, and it's not something we're willing to do.

Yes, the reasoning surprises a lot of shoppers.

FDA regulates vape devices, e-liquids, and their components and parts as tobacco products even when they contain zero nicotine, because they're parts of a nicotine-delivery system. Research from the National Institute of Mental Health shows that the human brain continues developing into the mid-to-late twenties, particularly the prefrontal cortex regions that govern decision-making and impulse control. The behavioral data point in the same direction: the overwhelming majority of people who develop a nicotine dependency start before 21. Raising the minimum age was designed to put distance between the most vulnerable window and the point of legal access.
